TERMS AND CONDITIONS

At Cycle Sector our goal is to make your purchasing experience as easy and efficient as possible. The following terms and conditions below explain how we process our orders and how we handle returns, exchanges, and refunds.

All use of this site, including the placing of any order at Cycle Sector, indicates your acceptance of the terms and conditions listed below. Please read the following policies, terms and conditions before submitting an order to Cycle Sector. These terms and conditions shall supersede all policies published on past web documents, sales receipts, and emails. Cycle Sector reserves the right to make changes to this site and these terms and conditions at any time without notice.

INDEMNITY:
You agree to indemnify and hold us and (as applicable) our subsidiaries, affiliates, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by you and/or any third party(s) due to or arising out of your use of this website or breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

EXCHANGE/RETURN POLICY:

We will be glad to accommodate exchanges if something you purchased doesn’t fit quite right.  In order to exchange or return an item, you must contact us within 3 days upon receipt of your order.  You may either call us or e-mail us at support@cyclesector.com. All exchanges and returns are subject to approval and RETURNS WILL NOT BE ACCEPTED WITHOUT OUR PRIOR APPROVAL!  We will provide you with an RMA number (Return Merchandise Authorization) which must be noted on the label on the returned merchandise.  Returns that do not include RMA number will be refused.  Note that a 20% restocking fee will be applied to all returns.

Exchange and return policies apply to all products we carry except all “group buy” purchases, closeout sales, custom made apparel, and any other products expressly stated as having no returns or exchanges.

Shipping costs are not refundable except for defective items or items sent in error. Defective items will be exchanged for the same items. Defective returns that are found to be non-defective are subject to the 20% restocking fee.

DO NOT DISCARD ANY PACKAGING OR INVOICES UNTIL YOU ARE COMPLETELY SATISFIED WITH THE PRODUCTS SHIPPED. ITEMS RETURNED WITHOUT THE ORIGINAL MANUFACTURER'S PACKAGING, OR DAMAGED PACKAGING MAY BE REFUSED OR RETURNED AND WILL BE SUBJECT TO THE RETURN POSTAGE COST.

All returns are subject to the following:

Shipping, insurance, and handling charges are not refundable. Returns should be shipped insured, as Cycle Sector assumes no liability for lost or damaged return shipments. Save your tracking numbers, as they can prove invaluable if your return is lost in transit to us. Your purchase must be returned with shipping pre-paid.

All products must be in "as-new" condition, in original packaging.

BACKORDERS:

You will be notified as soon as possible (usually within 24 hours) after placing your order whether any parts you have ordered are backordered with our distributors. If any of your purchased items is backordered, we will give you the opportunity to cancel that item with no penalty.

SHIPPING POLICY:

Cycle Sector will make a good faith effort to complete delivery of the products as indicated by the estimated shipping time listed on the website, but Cycle Sector assumes no responsibility or liability and will accept no backcharge for loss or damage due to delay or inability to deliver, whether or not such loss or damage was made known to Cycle Sector, including, but not limited to, liability for Cycle Sector's non-performance caused by acts of God, war, labor difficulties, accidents, delays of carriers, contractors or suppliers or any other causes of any kind whatever beyond the control of Cycle Sector. Under no circumstances shall Cycle Sector be liable for any special, consequential, incidental, indirect, or liquidated damages, losses, or expense (whether or not based on negligence) arising directly or indirectly from delays or failure to give notice of delay.

Shipping charges are calculated based on the total weight of all items in your order. The shipping cost charged at the time of purchase represents an estimate using FedEx Ground or US Priority Mail. Requests for Express Mail Service or special handling will be billed separately based on published rates plus a small shipping and handling fee.

Shipping charges are non-refundable.

INTERNATIONAL SHIPPMENTS:

Cycle Sector will not be held responsible or accountable for lost international packages.  We will ship to the address provided by the customer, however we cannot guarantee that the package will arrive.  There will be no refunds or credits for lost international packages.

SALES TAX:

Cycle Sector only charges sales tax on shipments to California. You, the customer, are responsible for any and all unpaid sales taxes.

COPYRIGHT:

Worldwide copyright laws and treaty provisions protect all materials appearing anywhere on Cycle Sector’s internet site. None of these materials may be copied, reproduced, modified, or distributed in any form or by any other means without the written consent of Cycle Sector. Any unauthorized use of the materials appearing on Cycle Sector’s internet site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

JURISDICTION:

Any litigation regarding this agreement or any transaction between a customer and Cycle Sector shall be brought to the state or federal courts located in San Diego County, California and the customer hereby agrees and submits to such jurisdiction and venue as proper.

TYPOGRAPHICAL ERRORS:

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Cycle Sector shall have the right to refuse or cancel any orders placed for products listed at the incorrect price without prior notification. Cycle Sector shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and the order is canceled, Cycle Sector shall immediately issue a credit to the credit card account in the amount of the incorrect price.

WARRANTY: THE BUYER'S SOLE AND EXCLUSIVE WARRANTY, IF ANY, IS THAT PROVIDED BY THE PRODUCT'S MANUFACTURER. CYCLE SECTOR MAKES NO EXPRESSED OR IMPLIED WARRANTIES. CYCLE SECTOR HEREBY DISCLAIMS ALL EXPRESSED OR IMPLIED WARRANTIES, WHETHER IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES, AND IN NO EVENT, WILL CYCLE SECTOR BE LIABLE FOR PERSONAL INJURY OR PROPERTY DAMAGE OR ANY OTHER LOSS, DAMAGE, COST OF REPAIRS OR INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR LIQUIDATED DAMAGES OF ANY KIND, WHETHER BASED UPON WARRANTY, CONTRACT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER CAUSE OF ACTION ARISING IN CONNECTION WITH THE DESIGN, MANUFACTURE, SALE, TRANSPORTATION, INSTALLATION, USE OR REPAIR OF THE PRODUCTS SOLD BY CYCLE SECTOR. BUYER HEREBY ACKNOWLEDGES AND AGREES THAT UNDER NO CIRCUMSTANCES, AND IN NO EVENT, SHALL CYCLE SECTOR'S LIABILITY, IF ANY, EXCEED THE NET SALES PRICE OF THE DEFECTIVE PRODUCT(S); NO ADDITIONAL ALLOWANCE SHALL BE MADE FOR THE LABOR OR EXPENSE OF REPAIRING OR REPLACING DEFECTIVE PRODUCTS OR WORKMANSHIP OR DAMAGE RESULTING FROM THE SAME. EXCEPT AS EXPRESSLY SET FORTH IN THIS PARAGRAPH, ALL PRODUCTS AND/OR SERVICES PROVIDED BY CYCLE SECTOR AND ITS EMPLOYEES AND AGENTS ARE PROVIDED "AS IS," "WHERE IS," AND "WITH ALL FAULTS."
